In Ontario a driver can only be penalized for a gap in insurance history if:

• your previous policy cancelled for non-payment
  
  
• you were convicted of driving without insurance during the lapse
  
  
• the lapse was a result of a suspension of your driver's licence as a result of a driving conviction
  
  
• the driver misrepresented their driving record about accidents and convictions, to avoid higher rates
